2. Acceptance of Terms
By submitting an enquiry through this website, bringing a Piece to our workshop, or accepting a written Estimate, you agree to be bound by this Agreement. If you do not agree, you should not use this website or engage our services.
You must be at least 18 years of age and have legal capacity to enter into a binding agreement. By engaging our services you confirm this.
Where you act on behalf of an organisation, you confirm that you are authorised to bind that organisation to this Agreement.
3. Service Description
Mainspring Works offers watch repair and timepiece restoration services from our workshop in Johor Bahru, Malaysia. Services currently available are:
- Diagnostic Assessment and Written Estimate (RM 470)
- Water Resistance Restoration and Case Rebuild (from RM 1,450)
- Long-Form Calibre Documentation and Overhaul (from RM 4,700)
Services are provided in-person at our Johor Bahru workshop. We do not currently offer postal or courier-based repair services. Availability of services is subject to current bench capacity.
4. Customer Responsibilities
- You are responsible for ensuring you are the lawful owner of any Piece brought to us, or that you have the owner's authority to engage repair services on their behalf.
- You must disclose any known history of the Piece that may be relevant to its repair, including prior service records, known damage or modifications.
- You must not submit a Piece that is subject to any legal dispute, lien, or court order preventing its alteration or movement.
- You must collect your Piece within 60 days of notification that it is ready. We reserve the right to charge a reasonable storage fee for uncollected pieces after this period.
- You must use this website only for lawful purposes and not attempt to disrupt, scrape without authorisation, or exploit the site.
5. Intellectual Property
All content on this website — text, images, graphics, and design — is the property of Mainspring Works or used with permission. You may view and print content for personal, non-commercial reference only. You may not reproduce, republish or redistribute any part without prior written consent.
Diagnostic reports and calibre dossiers produced for a Customer are the Customer's property. We retain the right to hold copies in our service records.
6. Payment Terms
- All prices are stated in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless stated otherwise.
- The Diagnostic Assessment fee (RM 470) is payable on collection of the report, regardless of whether further work is commissioned.
- For all other services, a deposit may be requested at intake. The balance is payable on collection of the Piece.
- We accept payment by cash, bank transfer, and major credit and debit cards at the workshop counter.
- We do not retain or refund the assessment fee if the Customer elects not to proceed with further repair work — the assessment is a standalone service and its fee reflects the work carried out in producing the report.
- If a repair is cancelled after work has commenced, a partial charge reflecting work completed to that point may apply. This will be discussed with you at the time of cancellation.
7. Service-Specific Terms
Scope and Changes
No repair work beyond the initial diagnostic is carried out without a written Estimate accepted by the Customer. If additional items requiring attention are discovered during work, we will pause and contact you before proceeding. Additional scope is not added without your written or recorded verbal agreement.
Timelines
Timelines stated at intake are estimates based on current queue. We do not offer penalties for delay. If a significant delay arises we will notify you. If you require a specific completion date, this must be agreed in writing at intake and is subject to capacity.
Parts and Materials
Replacement parts are sourced as original manufacturer stock, new old stock, or fabricated in-house. The source is stated in the service record and disclosed to you before fitment. We make no warranty as to the continued availability of any specific part.
Custody and Care
While your Piece is in our care, we take reasonable precautions to prevent loss or damage, including secure storage when not on the active bench. We maintain appropriate insurance. In the unlikely event of accidental damage or loss while in our custody, liability is limited as set out in Section 9.
8. Disclaimers
Our services are provided with reasonable care and skill. However, watch repair involves inherent uncertainties, and we make no representation that any particular outcome — rate accuracy, water resistance, longevity of components — will be achieved.
The condition of vintage movements can deteriorate during disassembly regardless of the repairer's care. We will inform you of any unexpected findings before proceeding further.
Website content is provided for general information only. Nothing on this site constitutes professional advice specific to your Piece.
9. Limitation of Liability
To the maximum extent permitted by Malaysian law, our total liability to you for any claim arising from our services or this website is limited to the amount you paid us for the specific service giving rise to the claim.
We are not liable for indirect, consequential, or special losses, including loss of value, loss of use, or sentimental loss arising from any service or failure of service.
Nothing in this Agreement excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law under the Consumer Protection Act 1999 (Malaysia) or other applicable statutes.
10. Indemnification
You agree to indemnify and hold harmless Mainspring Works and its personnel from any claim, loss or expense (including reasonable legal costs) arising from your breach of this Agreement, any misrepresentation made by you, or your violation of any law or third-party right in connection with a Piece brought to us.
11. Termination
Either party may terminate a service engagement before work commences by giving written notice. Once work has commenced, termination is subject to payment for work completed as noted in Section 6.
We reserve the right to decline or discontinue services where we have reason to believe a Piece is stolen, subject to a legal dispute, or where a Customer has acted in bad faith.
12. Dispute Resolution and Governing Law
This Agreement is governed by the laws of Malaysia. Any dispute should first be raised informally with us by contacting [email protected]. We will endeavour to resolve disputes within 30 days of written notification.
If informal resolution is not achieved, either party may refer the dispute to mediation through the Malaysian Mediation Centre before proceeding to court.
The courts of Malaysia in the jurisdiction of Johor shall have exclusive jurisdiction over any dispute not resolved by the above means.
13. General Provisions
- Entire Agreement: This Agreement, together with any accepted written Estimate, constitutes the entire agreement between the parties in relation to the relevant service.
- Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it in future.
- Assignment: You may not assign your rights or obligations under this Agreement without our prior written consent.
- Notices: Formal notices under this Agreement should be sent by email to [email protected] or by post to our workshop address.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected in the "Last Updated" date at the top of this page. Continued use of our website or services after changes are posted constitutes acceptance. Service engagements in progress at the time of any change continue to be governed by the terms in force at the time the Estimate was accepted.
